How To Find A Personal Injury Lawyer
DISCOVER HOW A PERSONAL INJURY ATTORNEY CAN HELP YOU

Medical Malpractice

Medical malpractice is negligence committed by a health care provider – often a surgeon, doctor, anesthesiologist, nurse practitioner, pharmacist, or hospital employee – resulting in harm to a patient. Medical negligence occurs when the health provider’s treatment falls below the general standard of care recognized by those with similar training and experience. When there is a condition where the general standard of care was not met then this means the health care provider acted inappropriately, unreasonably, unnecessarily, or not at all when action should have clearly been taken.

Debunking Some Personal Injury Myths

I cannot afford to talk with a personal injury attorney and it costs too much to think of hiring one.

Reality:  Within personal injury law most all lawyers use a “contingency fee structure.”

With this contingency fee structure, the attorney agrees to represent and work for on your case free of charge and then deducts their fee at the end of your case – only if they get a settlement or win your case in court.

I have insurance and all my cost will be covered if I get injured.

Reality: Most people working in the insurance companies are good people, however, insurance companies are concerned with their bottom line.  Car accident injuries are common for people to file personal injury lawsuits and it is easy to understand why.

Even if you have insurance protection, you could still end up having medical cost to pay even if you are the victim and your injuries were caused by the other party’s carelessness.  Not a very fair system, but this is why you need a competent personal injury attorney.

I don’t have to worry about filing a lawsuit.  I can do it latter.

Reality: A period limit known as a "legal time limit" normally begins starts the moment one is injured.  After two years elapsed, you can no longer file a personal injury lawsuit.

On several occasions when we meet with a customer during one of our free conferences and we find out their injuries have occurred past the state of limitations. This is distressing news after many costs have accumulated with their injuries that can become a huge financial burden over time.

There are some instances that can extend the time one can file a personal injury lawsuit, but they are limited and are legally complex.  This is why we encourage to anyone to contact an attorney as soon as possible after an accident or injury.

Frequently Asked Questions

What do I do after an accident or injury?

If you have been injured in an accident, the most important priority is getting medical attention. If you are not taken to the emergency room directly, you should try to take photos or videos of the accident area and get the contact information of any witnesses. Do not  admit fault or say you are sorry to anyone else who was involved in the accident, regardless of whether it appears to be a respectful. Anything you may say in the aftermath of an accident can be used against you if you pursue a claim or litigation later. If you suspect that someone else may have been at fault, you should set up a consultation with a lawyer to discuss your alternatives. The first consultation with an attorney is almost always free.

How do I know if I have a legal case?

You do not need to make this decision on your own. Contact an attorney and set up a free consultation to go over your situation in detail. The attorney will be able to tell you whom you can sue and what you can expect to recover, based on the facts of the accident and the laws in your state. Essentially, in most situations, you will have a case if someone acted carelessly under the circumstances and caused your injuries. Applying this standard is more complicated than it sounds, however, which is why it is important to consult an attorney.

Do I have a case if I do not feel injured?

You may still have a legal case even if you do not feel injured at the scene. The body's response to a traumatic condition as in an accident sends a rush of adrenaline through the body, which can temporarily reduce perception of pain. You may have significant pain or develope other symptoms much later. It is wise to contact a physician even if you do not feel any immediate or excruciating pain.  In many people, some of the most serious physical symptoms happen over a period of time.
